Photo Quality and Quantity: The quality and quantity of photographs delivered are contingent upon the full cooperation of the client, including all individuals participating in the session. In cases where the client, their spouse, or children are uncooperative, the quantity of photos may be adversely affected. Portraits By Kade shall not be held responsible for any shortfall in the agreed photo quantity resulting from a lack of cooperation.

Third-Party Rules: Portraits By Kade acknowledges that certain rules or restrictions may be imposed by third parties, including but not limited to churches, halls, venues, or religious organizations. While we will make every reasonable effort to comply with such rules, we cannot be held responsible for any limitations or compromises to the quality or outcome of our work resulting from these restrictions.

Termination of Contract: Portraits By Kade reserves the right to terminate this contract without issuing a refund if, at any time during the project or event, we feel that our safety is threatened or at risk. Additionally, we may terminate the contract if we encounter unreasonable restrictions that prevent us from delivering the quality of service expected by the client.

Deposit and Payment Terms: A non-refundable deposit is required to secure all bookings. A $100 deposit is required unless otherwise specified. The remaining balance is due in full at the end of the session. All images will be held and will not be edited, processed, or delivered until payment has been received in full.

Rescheduling and Cancellations: Sessions may be rescheduled one time with a minimum of 24 hours’ notice. Requests made with less than 24 hours’ notice will be considered a cancellation, and the deposit will be forfeited. Any canceled session will require a new booking and a new deposit to schedule a future session.

Location Fees: Portraits By Kade does not cover or include any location fees, permits, or licensing costs associated with the client’s chosen photography location. All such payments or fees are the responsibility of the client.

Uncontrollable Circumstances: Portraits By Kade shall not be held liable for events or conditions beyond its control, including but not limited to weather, traffic delays, or personal family emergencies.

Late Arrival Policy: Clients are expected to arrive promptly for their scheduled session time. Any late arrival will count toward the total session duration. Arrivals more than 20 minutes late without prior notice will be considered a no-show, and the session will be canceled. If advance notice is provided, the session may be rescheduled one time without penalty. Any additional rescheduling will require a new deposit to secure a future session.

Copyrights and Usage Rights: Portraits By Kade retains all copyrights, including but not limited to marketing, promotional, and sharing rights, for all photographs taken. Clients are granted a non-exclusive license to print and share the photographs for personal, non-commercial use without limitation. Any commercial use or reproduction of the images requires prior written consent from Portraits By Kade. If any images belonging to Portraits By Kade are found to be used for commercial purposes without authorization, legal action may be pursued.

Digital Downloads: Online galleries provided to clients will expire three (3) months from the date the link is issued. It is the client’s responsibility to download all images within the specified timeframe. Extensions beyond the initial three-month period may be granted upon request for an additional fee.
